Another handover delay does not mean the deposit is gone.Your contract usually says more than the developer is telling you.

A developer, a landlord, a tenant or a bank can sound very certain about what happens next. That does not make them right. Before you accept a delay, sign a cancellation or hand back the keys, have a senior advocate read the contract and tell you which deadlines and remedies are actually yours.

My off plan handover is more than a year late. What can I do?

Depending on the contract and on whether the project is registered and progressing, the options run from compelling delivery, to compensation, to recovering what you have paid with interest. What matters most is how the delays were notified and what you signed in response. Bring the addenda, not only the original agreement.

The developer is threatening to cancel and keep my money. Can they?

Only by following a defined procedure, and the notice requirements are strict. Cancellations have been set aside because the process was not followed correctly. Do not sign anything offered to you as a solution until it has been read.

Do I have to go to court?

Often not. RERA, the Land Department and the Rental Disputes Centre resolve a great deal, and a properly framed demand with documents attached settles a good number of matters before any filing. Choosing the forum is part of the strategy.

How long do these matters take?

It varies with the forum and with how the other side responds. You get a realistic range at the first conversation, and we would rather understate it than sell you a timeline we cannot hold.

Is the first consultation paid?
